Terms and Conditions
"Thinklabs" refers to Thinklabs Medical LLC, Centennial, CO 80111
"Plan" refers to this agreement.
"Covered Equipment" refers to the stethoscope covered by this Plan.
Coverage Term - 3 years from the date of purchase of the Covered Equipment.
Processing Claims - Contact Thinklabs at 1-800-918-1088, support@thinklabsmedical.com, or visit thinklabsmedical.com/support
Shipping - Customer pays for shipment to Thinklabs. Thinklabs will pay Ground or US Mail shipping for one shipment per year within the US. Thereafter, return shipping is $6 within the lower 48 states of the US and $12 to Alaska or Hawaii, via Ground or US Mail. Additional shipping applies to other regions or to 2nd Day or Overnight shipping.
Scope of Service, Repair or Replacement - Thinklabs may, at its option, repair or replace customer equipment and may replace with refurbished equipment, or newer equivalent model, in similar condition to Covered Equipment. Thinklabs may replace sub-assemblies with functionally equivalent used or new parts. Cosmetic damage such as scratches or dents that do not affect product performance is repaired at Thinklabs discretion only. Engraved parts may be replaced by non-engraved parts. In the event that your originally purchased model is replaced by an upgraded model, Thinklabs may charge an upgrade fee in addition to amounts listed above. Thinklabs reserves the right to replace existing models in the interests of advancing technology and product performance. Determination of source and cause of failure will be determined by Thinklabs service, and you agree to abide by Thinklabs determination of cause and proposed remedy (repair or replacement).
Product Replacement - If Thinklabs replaces your equipment, your previously owned Covered Equipment becomes the property of Thinklabs.
Standard Warranty - This Plan does not replace or supersede your standard product warranty, but provides additional coverage as provided for in this Plan. You may have additional rights under State law within the US.
No-Claims Rebate - May be combined with other discounts offered by Thinklabs or its distributors at the sole discretion of Thinklabs at the time of new product purchase. New purchase must be made within 90 days of completion of the Coverage Term. Rebate may not exceed the purchase price for this Plan.
Transferability - This Plan is not transferable to any third party without written permission of Thinklabs.
Cancellation or Changes - You may cancel this Plan within 30 days of purchase for a full refund, provided no services have been rendered under the Plan. Thinklabs may cancel the plan for fraud, material misrepresentation or non-payment by you. Thinklabs may modify the terms of this Agreement by mailing a modified agreement, in writing, to the address on record via US First Class Mail. In the event that Thinklabs makes such modifications, you will have 30 days to accept of reject the modified Plan. Should you decide to cancel this Plan as a result of a proposed modification, you must communicate your cancellation in writing to Thinklabs at the support address listed on the Thinklabs website at www.thinklabsmedical.com within 30 days of receipt of the modified plan. If you cancel, Thinklabs will refund a portion of the Premium, pro-rated according to the period remaining on this Plan.
Control - You are not responsible for failures to fulfill any obligation beyond your control, and Thinklabs is not responsible for failure to fulfill any obligation under its control.
Agreement - This is the entire agreement. In the event that any provision of this Plan is held to be invalid or unenforceable, the remaining provisions of this Plan will remain in full force and effect.
Communication and Registration - We will maintain current contact information for Thinklabs on our website at www.thinklabsmedical.com You are obligated to provide Thinklabs with current contact information during the term of this Plan in order that Thinklabs can communicate with you in regard to this Plan or to provide other information to you. Thinklabs may require you to register Covered Equipment in order to provide coverage under this Plan.
Limitation of Liability - Thinklabs or its affiliates are not liable for incidental or consequential damage resulting from the use of this equipment, and you agree that Thinklabs is not responsible for any consequences or damages that exceed the dollar amount paid by you for the Covered Equipment.
